The theory and practice of the complex approach to the separation of powers

My research focuses on the main function of the doctrine of separation of powers, namely, limiting central political power. Alongside the separation between functions, organizations, and persons (according to the classic approach to the doctrine) other legal institutions (eg. national referenda), social phenomena (eg. populism), and policies (eg. actions related to climate change) can have an impact on this function. Accordingly, the doctrine of separation of powers can be framed as a dynamic, multi-layered, complex system.

The methodology and function of the principle of proportionality

My research relates to the methodology of the principle of proportionality, as a method generally recognized and applied by the courts in the examination of limitations of fundamental rights. Special attention is paid to the application of proportionality in special legal orders, in relation to fundamental rights enjoying special legal protection, as well as other tests related to the examination of limitations of fundamental rights. I also examine the functions of proportionality, especially in relation to justification and procedural rationality.
